Managing Disability in the Workplace: A Review of the Complex Overlap Between Worker's Compensation, the Fair Employment and Housing Act, the Americans with Disabilities Act, and the California Family Rights Act

Floyd, Skeren & Kelly is pleased to announce the following advanced workshop: A Review of the Complex Overlap Between Workers' Compensation (WC), the Fair Employment and Housing Act (FEHA), the Americans with Disabilities Act (ADA), and the California Family Rights Act (CFRA)). The workshop is designed for employers, supervisors, managers, claims adjusters, and any other professionals associated with human resources and employment law. To ensure adequate time for all questions, in addition to a more "hands-on" approach, the workshop will be limited to 35 attendees. The workshop will cover important details related to the following  topics:

 • The complex overlap considerations pertaining to workers' compensation and the Fair Employment and Housing Act (FEHA)/Americans with Disabilities Act (ADA), including the definition of a disability, a review of what constitutes a reasonable accommodation versus an undue hardship, the interactive process (including practical advice on the specific steps to take in conducting an interactive process), job descriptions and essential functions, benefit continuation, fitness-for-duty examinations, medical leaves of absence, return-to-work policies, alternative/vacant position considerations. The presentation will also include a review of what an employer can expect, and what the employer should do, if an employee files a FEHA complaint alleging disability discrimination. 

• Highlights on the more complicated provisions of the California Family Rights Act (CFRA), including the overlap considerations with WC/FEHA, leave requirements, notification obligations, employee eligibility criteria, the definition of a serious health condition, medical certification, intermittent leave issues, benefit considerations, reinstatement, and required forms, in addition to five common mistakes that employers make in handling CFRA matters.

• As a bonus, the workshop will include an overview of the array of new legislation in effect as of January 1, 2012, including legislation related to Consumer Credit Reports; E-Verify; gender identity and expression; health benefits during pregnancy leave; and, the Wage Theft Prevention Act. In addition, the workshop will feature a review of the most significant employment related cases for 2011/2012, including cases involving age discriminaiton, disability discrimination, sexual harassment, and wage and hour issues.
