Join us on June 23, 2017 for a workshop that will cover hot topics in HR, including a review of the new transgender regulations in effect in California as of July 1, 2017, Post- termination workers’ compensation claims and managing disability in the workplace.”

This live workshop will be limited to 25 people.

10 am - 12 pm: HR Compliance is Complicated – 2017 Update Includes New Legislation, Cases and Key Trends Impacting the Workplace

  • Update on 4 key risk areas: Discrimination/harassment; meal and rest periods; leave of absence obligations; and, managing disability in the workplace.
  • New transgender regulations in effect July 1, 2017
  • New regulations related to background checks;
  • Fair Pay Act and increased scrutiny;
  • Update on Leaves of absences (FMLA/CFRA/PDL/PST);
  • Workplace drug testing policies and new legislation;
  • Accommodation of pregnant employees;
  • A review of the “Top 5 HR Forms”;
  • Pending 2017 legislation.

12 pm - 1pm: Working Lunch - Defending Good Faith Personnel Actions and Post-Termination Workers’ Compensation Claims

  • A comparison of managing injury claims of a current employee and a terminated employee;
  • Practical workplace strategies, including timely and proper documentation of performance issues;
  • Legal strategies;
  • Insight on the challenges of post-termination claims following personnel actions;
  • Review of the post-termination defense [Labor Code section 3600(a)(10)];
  • Exceptions to the post-termination defense.

1 pm  - 2 pm: Reducing the Risk of Costly Disability Discrimination Claims – Recommendations for Employer Best Practices

  • Case law and legislative update;
  • Best practices for complying with FEHA;
  • A review of the employer’s interactive process obligations;
  • A review of reasonable accommodation, including leaves of absence;
  • Discussion of medical certifications and opinions regarding accommodation.
  • Strategies for preventing workers’ compensation cases from evolving into costly FEHA lawsuits;
